We are Australia’s national workplace relations tribunal. Our work directly impacts on millions of Australians every day and the systems we contribute to creating and maintaining are essential to the prosperity and wellbeing of our society. We play a significant role in setting the national minimum conditions of employment and resolving disputes in workplaces. We also aim to support simple, fair and flexible workplace relations through exercising powers under the Fair Work Act. Our organisation consists of Members and Australian Public Service (APS) staff. Members are independent statutory appointees who perform a quasi-judicial role. They make legally binding decisions as part of their role. The report examines the history of wage-fixing and work value assessments in 12 of the 13 modern awards identified in the Stage 1 report. There are new protections for workplace delegates when carrying out their role. These laws commenced 15 December 2023 and cover most employees and businesses. A workplace delegate is a person appointed or elected by a union to be a delegate or representative for union members working in a particular enterprise. They have the right to represent the industrial interests of members and potential members. There are new general protections relating to family and domestic violence. The Fair Work Act prohibits an employer from taking adverse action against an employee, or potential employee, because of their protected attribute. ‘Subjection to family and domestic violence’ is a now protected attribute.
